General Terms and Conditions
PSGameZone – Tom Sohr, Oberdorf 24, 09518 Großrückerswalde, Germany
§ 1 Scope
(1) These General Terms and Conditions (hereinafter "T&Cs") apply to all contracts concluded between Tom Sohr, owner of PSGameZone (hereinafter "Seller"), and the buyer via the online shop psgamezone.de and all other sales channels (eBay, Amazon, Kaufland, Eneba, Gamivo, Kinguin, etc.).
(2) Deviating, conflicting or supplementary terms and conditions of the buyer shall not become part of the contract, unless the Seller expressly agrees to their application in writing.
(3) These T&Cs apply both to consumers within the meaning of Section 13 of the German Civil Code (BGB) and to businesses within the meaning of Section 14 BGB, unless a distinction is expressly made.
§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).
(2) By clicking the "Buy" or "Complete order" button, the buyer submits a binding offer to purchase the products in the shopping cart.
(3) The Seller will confirm receipt of the order by email without undue delay. This confirmation of receipt does not yet constitute acceptance of the offer. A purchase contract is only concluded when the Seller accepts the order by means of a separate order confirmation or by delivering the goods.
(4) The Seller reserves the right to reject orders without giving reasons, in particular in case of suspected misuse or if the product is unavailable.
§ 3 Prices and Payment
(1) All prices stated are final prices and include statutory value added tax as well as other price components.
(2) For physical products, shipping costs may apply additionally and will be shown separately before the order process is completed.
(3) Payment is made using the payment methods offered in the order process (e.g. PayPal, credit card, instant bank transfer). The invoice amount is due immediately upon conclusion of the contract.
(4) In the event of late payment, the Seller is entitled to demand default interest at the statutory rate.
§ 4 Delivery – Digital Products (Game Keys, Credit Codes)
(1) Digital products (game keys, activation codes, credit codes) are made available without undue delay after successful receipt of payment, usually within a few minutes, by email or directly in the customer account. No physical shipping takes place.
(2) The buyer is obliged to check that the email address provided is correct. The Seller is not liable for delays or non-delivery caused by incorrect contact details.
(3) The buyer must ensure that the purchased key is compatible with their region and platform. Region information is stated in the product description. Return or refund in case of incompatibility due to the buyer's wrong choice of region is excluded.
(4) Keys may only be purchased for personal use. Commercial resale is prohibited without the Seller's express written permission.
§ 5 Delivery – Physical Products
(1) Physical products (e.g. game packaging, hardware, accessories) are shipped after receipt of payment to the delivery address provided by the buyer. The delivery time is usually 2–5 working days within Germany, unless stated otherwise.
(2) For deliveries abroad, different delivery times and, if applicable, additional shipping costs apply, which are shown in the order process.
(3) For consumers, the risk of shipping is borne by the Seller; for businesses, it passes to the buyer upon handover to the shipping carrier.
(4) Partial deliveries are permitted, provided this is reasonable for the buyer.
§ 6 Pre-Orders
(1) For pre-orders, the purchase price is due and charged at the time of the order, unless a later due date has been expressly agreed.
(2) The Seller will endeavor to provide pre-ordered digital products (game keys) on the official release date or as early as possible thereafter. No guarantee can be given that the key will be delivered exactly on or before the release date. Delays may arise in particular from late key provision by the publisher or distributor, over which the Seller has no influence.
(3) The same applies to physical pre-orders: the Seller ships the goods as soon as possible, usually on or shortly after the official release date. Receipt by the buyer exactly on the release date cannot be guaranteed due to shipping times.
(4) If delivery of a pre-order is delayed by more than 30 days after the announced release date, the buyer is entitled to withdraw from the contract and receive a full refund.
(5) If a pre-ordered product is not released or the Seller is unable to obtain it, the buyer will be informed without undue delay and the purchase price will be refunded in full.
§ 7 Right of Withdrawal
(1) Consumers are generally entitled to a statutory right of withdrawal. The withdrawal period is 14 days from conclusion of the contract (for digital products) or from receipt of the goods (for physical products).
(2) Exclusion of the right of withdrawal for digital content: For digital products (game keys, activation codes, credit codes), the right of withdrawal expires prematurely pursuant to Section 356(5) BGB as soon as the Seller has begun performing the contract and the buyer has expressly agreed that the Seller begins performance before the withdrawal period has expired, and the buyer has confirmed their acknowledgement that, by giving this consent, they lose their right of withdrawal once performance begins.
(3) The consent and acknowledgement pursuant to paragraph 2 are given by ticking the corresponding checkbox in the order process. Once the key has been provided, there is no longer any right of withdrawal.
(4) For physical products, the statutory right of withdrawal applies without restriction, provided the packaging has not been opened. For opened physical games with an activation code, the right of withdrawal is excluded as soon as the enclosed code has been revealed or activated.

§ 8 Warranty
(1) The statutory warranty rights apply. The warranty period is two years from delivery of the goods.
(2) For digital products, the Seller undertakes, in case of proven invalidity or non-functionality of a key, to provide a replacement key or refund the purchase price. The buyer must prove the invalidity by submitting a screenshot or other evidence.
(3) No warranty claim exists if:
- the key has already been activated or passed on by the buyer or third parties,
- activation fails due to a wrong choice of region or platform,
- the buyer does not meet the system requirements,
- the error is attributable to a third-party system (e.g. Steam, PlayStation Network) over which the Seller has no influence.
(4) Towards businesses, the warranty is limited to subsequent performance; the right to price reduction or withdrawal exists only if subsequent performance fails.
§ 9 Liability
(1) The Seller is liable without limitation for damages resulting from injury to life, body or health as well as for damages caused intentionally or through gross negligence.
(2) In case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the damage that is foreseeable and typical for this type of contract.

§ 10 Data Protection
The collection, processing and use of personal data takes place exclusively within the framework of the applicable data protection provisions. Further details are set out in the Seller's privacy policy, which is available at psgamezone.de/datenschutz.
§ 11 Copyright and Rights of Use

Passing on, reproduction or commercial use is prohibited without the express permission of the rights holder.
§ 12 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which is available at https://ec.europa.eu/consumers/odr.
The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
§ 13 Applicable Law and Jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Towards consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions of the state in which the consumer has their habitual residence.
(3) Towards businesses, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's registered place of business in Großrückerswalde, Saxony.
§ 14 Severability Clause
Should individual provisions of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the valid and enforceable provision whose effects come closest to the economic purpose of the original.
